Version 2026-10-30-draft-3
Private Viewing Offer Terms
Draft for review, not yet in force. Items in square brackets are still to be confirmed. Online offers are not being accepted until these terms are finalised.
1. About us
These terms apply to offers made through Samuel Wray-Easton Private Viewings. The seller is [seller's full name or trading name: to be supplied], of [geographic address: to be supplied]. You can contact us at [art-sales email address: to be supplied].
2. The private viewing
Each painting has its own private viewing of 48 hours. For Bank Winter Night it opens on Friday 6 November 2026 at 18:00 and closes on Sunday 8 November 2026 at 18:00, UK time. Our server's clock decides whether an offer was made inside the viewing; the countdown on your screen is a guide.
3. Who can make an offer
Collectors in the UK and abroad are welcome. You must be 18 or over and give your real name, an email address you control and the country the painting would be delivered to. Offers are private: we never show other people's offers, how many offers have been made, or whether your offer is the highest.
If you make an offer to us by Instagram, telephone, email or in person, we may record it for you. It counts only after you confirm it on our website through the private link we send you, accept these terms and verify it by email, all before the viewing closes. For tie-breaking, its time is when you confirm it on the website.
4. Making an offer
- Offers are in whole pounds sterling and must be at least the minimum opening offer shown when you choose Make a Private Offer. For Bank Winter Night the minimum is £500.
- You may raise your offer during the viewing. Your highest offer counts.
- Your offer is for the painting only, in pounds sterling. It is a commitment to buy at that price if it is confirmed as the winning offer, once delivery and the full total have been agreed with you (section 9). This is subject to your right to cancel (section 10).
- You will see a reference number and a verification code. Keep them.
- We record the version of these terms you accepted with each offer.
5. Verifying your email
An offer only becomes eligible once you have verified your email address. To do this, send the verification code shown on screen, from the same email address you used for your offer, to our art-sales inbox. It must arrive by Sunday 8 November 2026 at 22:00 UK time. We do not send verification emails.
6. Reserve
The painting may have a private reserve price, which we do not disclose. If no eligible offer reaches the reserve, the painting is not sold through this viewing.
7. How the winning offer is decided
- The highest eligible offer at or above the reserve wins.
- If two or more eligible offers are for the same amount, the one our server accepted first wins. If they were accepted at exactly the same moment, the one with the lower internal sequence number wins.
- Before any payment is requested, we check the automatically determined winning offer. We treat an offer as ineligible only if it was not verified in time, is a duplicate, uses false details, is made by someone under 18, breaks these terms, or (after a payment request) is not paid on time. We record the reason, and the next highest eligible offer is then considered in the same way.
- We contact the winner by email. We do not publish the result.
8. Payment
- We send the confirmed winner a private link to a payment page showing the painting price, the agreed delivery charge and the total, all in pounds sterling (GBP). Payment is made through Stripe's secure checkout. If your card is in another currency, your card provider may convert the amount and charge fees.
- We never ask for card details by email or phone, and we never see or store card details.
- A payment counts only when Stripe confirms it to us. The painting is not dispatched or handed over before then.
- Payment is due within [48 hours: recorded; 24 hours proposed, to be confirmed] of our payment request.
- If payment is not received in time, we review the sale. We may withdraw it and may invite the next highest eligible bidder to buy at their own offer; they are free to accept or decline. No one else is ever charged automatically.
9. Delivery, international buyers and customs
- UK: insured delivery, or collection in London by arrangement.
- International: we currently ship to [the United States; other supported destinations to be confirmed]. If your country is not yet confirmed, we tell you whether we can ship there before your offer can become binding. Some countries restrict imports of artworks; we check before quoting.
- Delivery is quoted separately. We agree the delivery method and charge with you before sending the payment request; nothing is added without your agreement. If we cannot deliver to you, or you do not accept the delivery quotation and collection is not possible, [either of us may withdraw without charge: proposed, to be confirmed].
- Import duties, taxes and customs charges in your country are not included in the price or delivery charge and are payable by you.
- Risk passes to you when you, or someone you nominate, receive the painting.
10. Your right to cancel
If you are buying as a consumer, you have the right to cancel within 14 days of receiving the painting without giving a reason. Tell us by email within that time. You must return the painting within 14 days of telling us, in the condition you received it. Return postage: [who pays: to be confirmed]. We will refund the price and the standard delivery charge within 14 days of receiving the painting back, or proof that you have sent it. This does not affect your rights if the painting is faulty or not as described.
11. Description
We describe each painting as accurately as we can. Photographs show the painting outdoors and on location; colours may vary slightly between screens. Dimensions are approximate.
12. Your information
How we use your name, email and offers is explained in our privacy notice.
13. If something goes wrong
If a technical fault prevents offers or affects a viewing, we may extend, pause or cancel that viewing. We do not accept offers made outside the viewing.
14. Law
These terms are governed by the law of England and Wales. If you live elsewhere in the UK, you may also bring proceedings in your local courts.
